Administrative Liability for Illegal Lobbying: Rules for GR and Lobbying Companies
On October 27, the National Agency on Corruption Prevention (NACP) published an official clarification regarding administrative liability for violations of lobbying legislation. This is one of the first practical steps in implementing the Law “On Lobbying,” which came into force on September 1, 2025. For the first time, Ukraine now has a clear system of penalties for those who ignore the new transparency rules.
Liability applies to several typical violations — conducting lobbying without registration in the Transparency Register, failing to submit or submitting reports late, violating established procedures, or providing false information. In such cases, financial sanctions are imposed — fines determined by the nature of the violation. If the violation is repeated, the amount of the fine increases. This sends a clear signal: lobbying is now treated with the same level of legal rigor as other regulated professional activities.
For businesses and GR companies, this means that a formal or negligent approach to registration and reporting may have tangible financial consequences. At the same time, it is also an opportunity to raise professional standards by introducing internal compliance, reporting, and monitoring systems to ensure adherence to the law.
As the NACP emphasizes, the main goal of these sanctions is not to punish but to instill discipline among participants in the lobbying process, making it transparent, honest, and predictable. Ukraine’s regulatory framework is gradually aligning with European standards, where lobbying is recognized as a legitimate but strictly regulated instrument of influence on public policy.
The new fines are a reminder that integrity and accuracy in GR activities are now not only a matter of reputation but also of financial responsibility.
